The power of national courts to revoke unlawful state aid
Date: 08/12/2011In its judgement dated 8 December 2011, the Court of Justice of the EU reaffirmed the power of national courts to revoke unlawful state aid. In the event a certain entity was awarded state aid unlawfully, implemented by means of a guarantee provided by a public authority to secure a loan granted by a finance company, which the entity would not have been able to secure in normal market conditions, national courts have jurisdiction to cancel such guarantee, in particular where the cancellation would lead to the restoration of the competition on the market.
