Contractual condition restricting the sale of certain products on the Internet constitutes competition restriction
Date: 13/10/2011In its judgement of October 13th 2011, the European Court of Justice ruled that the contractual condition arising from selective distribution, under which the sale of cosmetics and personal hygiene products must be carried out in brick-and-mortar premises under the supervision of a qualified pharmacist, which means a ban on the sale of such products via Internet, constitutes a competition restriction if, in regard to the concerned products characteristics such condition is not objectively reasonable.
