Violation of right to judicial protection in filing motion for execution of a state enterprise in liquidation
Date: 13/10/2011Under the judgement of the European Court for Human Rights of October 11th 2011 in the case Viskupová vs. The Slovak Republic, it is considered as violation of rights to judicial protection when a private person is not able to seek enforcement against a state-owned enterprise in liquidation, which does not appear to be insolvent, and also due to inadequate legislative or enforcement practice of the courts.
