Violation of the right to a fair trial in the context of a general meeting
Date: 12/01/2012On 12 January 2012 European Court for Human Rights decided a case where the plaintiff, a company, filed several petitions seeking violation of its right to a fair trial and the right to protect its property. This was due to the fact that national courts issued several injunctions banning the company from holding a general meeting in the light of a pending dispute over the ownership of the majority of the company shares. The court held that the day-to-day operations and management of the company were not affected and the right to undisturbed use of the company’s property. On the other hand, the court found that the plaintiff’s right to a fair trial was violated, as the appellate court ruled only after the original dates of the general meetings elapsed and restricted its decision only to dismissing the appeals without a further consideration.
