YUKOS v Russia settled in Strasbourg
Date: 20/09/2011In its judgement in YUKOS v Russia, the European Court for Human Rights ruled, among other, that it is considered breach of right to fair trial if a participant was not provided time enough to study the case file (in this case 43 000 pages in 4 days), and also if there was a short time interval between the end of the first instance proceedings and the beginning of the appeal proceedings (in this case 21 days). At the same time, the European Court ruled that when executing such decisions, the state authorities should opt for such measures, which guarantee balance between the legitimate goals of the execution and the measures chosen.
