Ružička Csekes on the issue of BUILDING MOTORWAYS ON PRIVATE LAND
Date: 30/06/2011Constitutional Court of the Slovak Republic (“Constitutional Court”) ruled in its plenary session dated January 26, 2011 that certain provisions of Act 669/2007 Coll. on non-recurring extraordinary measures applicable during preparation of certain construction of highways and carriageways and on amending Act 162/1995 Coll. on real estate cadastre (“Cadastre Act”) adopted by National Council of the Slovak Republic, as amended (“Extraordinary Measures Act”) are at variance with the constitution of the Slovak Republic as promulgated by Act 460/1992 Coll. as amended (“Slovak Constitution”) and with Protocol No. 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms. The decision has put an end to the discussions regarding the unconstitutional character of the measures, which were adopted in 2007 to accelerate the construction of high-priority road infrastructure, i.e. motorways and expressways.
